Clinical negligence
If you attend a hospital or see a doctor or any other medical practitioner your problem is usually dealt with competently. Sometimes, however, things do go wrong and this can be traumatic not merely for the victim but also for the family. In these circumstances clear and expert advice about medical issues and the nature of the medical accident can offer some reassurance to the victim where otherwise there is confusion and uncertainty. Our clinical negligence team is headed up by Yasmin Ameer who is a member of the Law Society’s Clinical Negligence Panel.
Panel membership is granted by the Law Society to solicitors who have the experience and the expertise in dealing with clinical negligence work. This work is recognised to be so complex that the Legal Services Commission (LSC) will only offer public funding (Legal Aid) to solicitors who are members of the Clinical Negligence Panel. Ameer Meredith have an LSC franchise which enables us to represent Clients with the benefit of Legal Aid if the Client qualifies for public funding.
Our team has access to a large number of medical experts who provide advice and reports on medical accidents. These experts are tried and tested over a number of cases and are only included in our list of expert witnesses where we have experience of their quality of work and expertise or who come with recommendations from other respected lawyers who have such expertise.
We have a wide ranging database of medical and other experts, specialist Queen’s Counsel and Barristers and as such, we are able to utilise their specialist expertise to the best advantage of the client.
Where we are contacted by a victim of a clinical accident we act quickly in order to provide advice, not only on the claim but also to address important and practical issues to the client such as financial difficulties where the client and/or the principle carer is unable to work. We are able to advise on welfare benefits, insurance claims and we are prepared to undertake any other investigations that may be necessary to help the client to address immediate financial problems so that the emphasis can be on the client’s recovery.
At the initial interview and from thereon we will give you clear advice as to the nature of your claim, the action that we will take in order to pursue your claim, the nature of litigation and the value of your claim. We are honest in our approach and endeavour to ensure that the client has a clear understanding of his or her claim. We consult with the client at every step of the case so that the Client is fully aware of what is happening on the case. Our aim is to make sure that the claim is led by the Client and not the other way round.
We have dealt with several claims against hospitals and doctors ranging from the smallest of claims to significant injuries such as traumatic brain injury, cerebral palsy and severe burns.
Some of the areas we have recently covered include:-
- Birth injury resulting in cerebral palsy
- Misdiagnosis of a tumour resulting in loss of sight
- Severe burns arising from negligence of a carer
- Over-prescription of drugs
- Dehydration resulting in brain injury
- MRSA
- Mis-prescription of drugs resulting in loss of hearing
- Various surgical accidents
Legal Aid
We have a Legal Aid franchise. We will advise you as to whether you will be entitled to have Legal Aid to fund your claim at our first meeting.
No Win No Fee
No win no fee work is referred to by lawyers as “Conditional Fee Agreements. This involves you entering into an agreement with us. We will specify that we will not charge you for our fee if we do not succeed in your claim. If you lose your claim (in cases where there is no Legal Aid) you will have to pay the Defendants’ costs. We will, therefore, take out an insurance policy that will do this for you. |
